GENERAL CONDITIONS OF USE AND PURCHASE OF NER-TOR.COM

By placing an order, the Client, as the purchaser of the products marketed, declares that he/she has read and is aware of these conditions, as well as the rates, shipping costs and promotions in force, and has expressly accepted them prior to placing the order. Any obligation and/or right corresponding tohttps://nertor.com/gb/ according to these GTC may be executed by NER-TOR S.A. directly or by the third party(ies) it designates. APPLICABLE TO THE PURCHASE AND SUPPLY OF PRODUCTS
1. ORDER OF THE PRODUCTS.
In order to purchase the products (hereinafter referred to as the PRODUCTS), the Customer must place an order through the websitewww.https://nertor.com/gb/By filling in the electronic form that appears at any given time on the shop's website and following the instructions indicated therein, indicating the quantity and type of the PRODUCTS you wish to purchase. The PRODUCTS available and, where applicable, the minimum purchase quantities are shown atwww.https://nertor.com/gb/And in the catalogue in force at the time.
The validation of the order by the customer expressly implies knowledge and acceptance of these general terms and conditions as part of the conclusion of the contract.
2. AVAILABILITY, DELIVERY AND RECEIPT OF PRODUCTS.
2.1. The quantity and variety of the ordered PRODUCTS and the delivery time of the same will be subject to the availability at any given timehttps://nertor.com/gb/In case of unavailability,https://nertor.com/gb/Will notify the Customer within a maximum of 24 working hours before the scheduled delivery day of the order (excluding Saturdays, Sundays and public holidays). After this period the order shall be deemed to have been accepted by the Customerhttps://nertor.com/gb/.
The approximate delivery time will be informed at the time of validation of the order and will depend on the delivery address.
Delivery of the Products will be made to the address designated by the Customer in accordance with the General Terms and Conditions of Sale indicated atwww.https://nertor.com/gb/Or whoever it designates to act on its behalf, shall not accept orders or make deliveries outside the parameters stipulated in the General Terms and Conditions of Sale.
In the case of an order for several items with different availabilities, the delivery time will take into account the longest expected delivery time. In exceptional cases,https://nertor.com/gb/Reserves the right to break down the order, sending the available items and leaving the unavailable items pending a second shipment. In this case, the second shipment will be made at no additional cost.
2.2. Upon receipt of the PRODUCTS, the Client (or the person acting on behalf of the Client and under his responsibility) must sign a delivery note (also noting the ID card, NIE or Passport number of the signatory) as proof of the Client's agreement that (i) the delivery has been duly carried out at the agreed place and on the agreed date, (ii) the PRODUCTS delivered have been all those ordered by the Client, (iii) the Client has been informed prior to placing his order of the official prices of the PRODUCTS, the delivery costs, that the applicable indirect taxes are included in the prices and the promotions in force, (iii) the Client has been informed prior to placing his order of the official prices of the PRODUCTS, of the shipping costs, that the applicable indirect taxes are included in the prices and of the promotions in force, and that (iv) the PRODUCTS delivered have been inspected by the Client and are free of apparent defects.
2.3. 2.4. The Customer assumes the risks of deterioration, deterioration, damage and loss of the PRODUCTS from the delivery of the same byhttps://nertor.com/gb/(or its designee) at the Customer's address indicated at the time of placing the order.

2.9. Shipping and/or handling costs are not included in the price and will be shown for your express acceptance, before finalising the purchase, depending on the delivery address of each order and the delivery method chosen.
2.10. Shipping costs, if any, include packaging, handling and delivery. They may contain a fixed and a variable part based on the price or weight of your order. We recommend that you consolidate your purchases into a single order to avoid two separate delivery orders and therefore two delivery charges.
3. PRICES AND PROMOTIONS

3.2. The delivery note delivered together with the PRODUCTS shall include details of the quantity and type of the PRODUCTS, their price and the date and place of delivery. The payment of the price may be made (i) by means of the payment methods stipulated in the Payment Conditions informed at www.https://nertor.com/gb/ and in the catalogue in force at the time. https://nertor.com/gb/ offers a variety of payment methods so that the customer can choose the one that suits him best.https://nertor.com/gb/Shall issue and, if requested, send to the Customer an invoice for the products delivered.
3.3. In the event that the Customer does not pay or has not paid the price of the order/purchase at the time of delivery,https://nertor.com/gb/Shall be entitled not to deliver the PRODUCTS and to charge you for the delivery costs of the visit together with the costs and price of the next order.

4. RETURNS, COMPLAINTS AND COMMUNICATIONS
4.1 In cases where the order is not in accordance with the customer's request in www.https://nertor.com/gb/, if the product has been damaged during transport, the Customer shall have a period of 14 days from the date on which he/she became aware of the non-conformity of the order to notify it. No returns will be accepted for opened PRODUCTS, in packaging other than that in which they were supplied or in packaging damaged by the Client, or when they have been separated from the packs in which they were supplied. Nor will returns of products be accepted after 14 working days following receipt of the same; except in cases where the reason for return is due to an incident of the product in origin.
4.2 Warranty: The warranty period is two years, although it does not include deficiencies caused by negligence, knocks, incorrect use or improper handling, incorrect installations not carried out by authorised Technical Services where applicable, etc., or materials that are worn out due to use.

5. INDUSTRIAL PROPERTY RIGHTS
The purchase and supply of the PRODUCTS marketed under any of the brands marketed under "..."https://nertor.com/gb/"do not grant the Client any industrial property rights over these brands and other distinctive signs or designs of the PRODUCTS and their packaging or those of NER-TOR itself, S.A..
6. DATA PROTECTION
NER-TOR, S.A. informs the Customer that the personal data collected when placing an order will form part of two databases, one owned by NER-TOR, S.A.., the purpose of the information provided is to attend to your request, maintain commercial contact and send, including by electronic means, information about activities, promotions, news, products, services, promotions and information that may be of interest to you and other information owned by NER-TOR, S.A. in order to invite you to form part of its database and thus send you advertising based on your preferences and hobbies about products and activities organised and/or sponsored by NER-TOR, S.A. The above treatments are compulsory.
To exercise the rights of access, rectification, cancellation or opposition against NER-TOR, S.A.., the request must be made in writing, identified by the reference "Data Protection", specifying the request and accompanied by a photocopy of the D.N.I. of the interested party, to the following address: PolÃgono Industrial Vilapou, Nave 5, 08640-OLESA DE MONTSERRAT.

7. RESIGNATION
Failure by either party to require strict performance of any contractual term on one or more occasions shall in no event be deemed a waiver, nor shall it deprive that party of the right to require strict performance of the contractual obligation(s) at a later date.
8. APPLICABLE LAW AND JURISDICTION
These GCCG NER-TOR.comShall be governed by Spanish common law. The parties submit, at their choice, to the Courts and Tribunals of the user's domicile for the resolution of conflicts and with waiver of any other jurisdiction, to the Courts and Tribunals of the user's domicile. In the case of a sale and purchase made by a company acting within the framework of its business or commercial activity, both parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of Barcelona (Spain).
